The Beijing Court Trial Information Network released the first-instance civil judgment of the portrait right dispute between Liu Xiang and Beijing New Oriental Vision Overseas Consulting Co., Ltd. on the 7th.

 

According to the judgment, Liu Xiang sued That Beijing New Oriental Vision Overseas Consulting Co., Ltd. used Liu Xiang's own portrait and attached commercial publicity information in the article "From Liu Xiang 8 years ago to Fu Yuanhui this year, China is really strong" published by the WeChat public account "New Oriental American Middle School Study Abroad" without permission.

 

The court held in the first instance that the defendant's use of Liu Xiang's portrait in the article published by the public account involved in the case without consent constituted an infringement of Liu Xiang's portrait rights. Although the article involved in the case used the plaintiff's portrait, the relevant photos were the plaintiff's photographs of the arena, and the portraits were not defaced, and the infringement was minor.

 

According to the judgment, Beijing New Oriental Vision Overseas Consulting Co., Ltd. apologized in writing to the plaintiff, Liu Xiang, and compensated Liu Xiang for economic losses of 6,000 yuan.
